15 year old black girl man handled, punched, and pepper sprayed by cop in Florida

FORT PIERCE, Florida 15 year old Shelwanda Riley, is facing a felony battery charge from a curfew violation incident in which city police officer Dan Gilroy slammed her against his hood and then struck and pepper sprayed her after she bit him.

I really don’t know what to say about this…I’m so disgusted. There has been a good amount of local coverage on this case, some national coverage, but I’d like to see more. 

I understand that she bit him…she was wrong for that, but she wasn’t in a rational mind set…that’s obvious, and she’s a child. Also, he was wearing protective gloves to guard against bites at the time.

“Gilroy, who was wearing cut-resistant gloves that protected him from serious injury, struck the 100-pound girl in response to the bite, the report said.

“(She) left a large amount of saliva on my wrist as she took a full bite,” the officer wrote. “My wrist was red and slightly bruised, but there was no broken skin.””

The police officer is using all of these words like “resist” so that his abuse will stand up to the law in court because he knows that he’s on camera. It’s a scare, 15 year old…come on man!!! She looks like she weighs about 100 pounds…soaking wet. You mean to tell me that officers are not taught any techniques to subdue women or to subdue frail people? There are no instructions other than force, regardless of size or age?

And…this superiors support him.

“Fort Pierce Police Chief Sean Baldwin said he stands by how Officer Dan Gilroy handled the July arrest.

“It is shocking to see that a police officer has had to use that level of force against a child,” Baldwin said Thursday night. “But … my opinion is he responded appropriately and in accordance with our policies.

“I do not expect my officers to stand there and allow a child or an adult to bite them,” he added.” – tcpalm.com (click here for more information on this story)

A representative of Rev. Al Sharpton’s National Action Network called for Fort Pierce Police Officer Daniel Gilroy’s immediate suspension while the department investigates the arrest.  That’s not enough for me.  In light of the Jena 6 and the Dunbar Village case, I feel that we all know when an injustice is going on…more than enough time was spent onMick Vick while these cases were just breaking (and they continue to give that Negro too much press!!!)  I believe that children and teens should not be treated like adults in our criminal system.  There should be special considerations, just as we don’t (and I use don’t very loosely, because sometimes we do) charge children as adults and we have a juvenile system.  We recognize that there is a difference.

  2. I’ve seen this video a few times… and I always have the same questions. Why was she out beyond the city’s curfew time (she’s 15, was she out alone, cause she’s the only getting arrested)? Did she put up a fight because she was afraid? Did the police officer overstep his bounds? If the police officer was black, would people be reacting the same way? How about if both in the video were white — would a lot of people even still care?

    I think we’re all used to seeing ‘rough’ arrests by now, so I’m not going to argue with the officer’s tactics… if that little girl was a handful, well, I guess she had to be manhandled. I don’t see, however, how punching someone in the face is a plausible police tactic. I believe if the officer making that arrest could see a video of his 15-year-old daughter being arrested in like manner, he’d have a fit and want blood as well.

    We all need to see and know what events led up to the arrest before we can really call her the girl victim or the cop a pig.

    She is using this for publicity.
    She was in the wrong, he was a uniformed officer, he asked nothing of her but to obey the word of an officer, she fought and bit an officer doing his job.
    I don’t care what color she is or what law she was violating or how old she is or if she is male of female… if you are caught violating a law you are supposed to do what law enforcement says to!

    Stop playing the race card. This girl was visibly resisting arrest, and assaulted a uniformed officer. She deserved to get a crack in the face. Maybe if her parents gave her a whack one and a while she wouldn’t be roaming the streets by herself at 1:30 AM. Her parents are quick to stand by her now, but where were they with guidance before this incident. The officer was just doing his job.

    Jim, you should re-read my comments. I’m focused on her age and size. If this was a grown man for example, someone who weighs more than 115 pounds, someone similar in size with the officer…I would not think this was shameful.

    I am not sure where it gets lost how many times he told her to put her hands behind her back. What did he have to do to get her to comply? I don’t think she was scared at all, look at her facial expressions that are as clear as day on that tape. Right before she gets sprayed you see the look of an adolescent throwing a fit. Was she in pain? My guess would be no, there are points throughout the tape where he has her arm almost all the way up her back and she is apologizing and saying she didn’t do anything. Just an act put up by some spoiled little kid.

  11. This is not a case of 2 strangers. What kind of training are officers receiving. Is it customary to punch and mace and female that you are trying to restrain a female subject of this age and size? It seems excessive to me.

    I cannot see how such a force is necessary. Please if a child bites his mother I cannot see that mother taking pepper spray to the child. And trust me..that video also shows him grabbing her breast. Something is definitely wrong with the racism factor in this country because if it was a black guy as maud is asking..i doubt he would be cuffing and pepper spraying her. I think black officers need to start cuffing and pepper spraying white offenders..you’ll see how quick the white community will be in an uproar and how quickly that black cop will be dismissed.     This case really shows how people are polarized. Blacks defend her actions. Whites defend the cop. What is so regrettable is that this girl and the cop are the subject of so much discussion. If you really want the justice system to change, defend somebody who is innocent or was really abused, because cases like this are not worth the effort. This is just a tape making the rounds for our amusement. Some drama queen breaking curfew (under suspicious circumstances though) who decides not to cooperate and then bite a cop. Later claiming the ‘I WAS SCARED” defense. Puhleeeze. Don’t we see that on every episode of COPS? Give us a new one. In the meantime, we can all enjoy watching her scream, especially after she was pepper sprayed. Not becuse she is black, but because she is a drama queen. And who loves a drama queen?

    Why is it okay for a policeman to punch a child in the face? If that were my child, (regardless of whether or not she bit me) and I punched her in the face CPS would receive a call for abuse. That child is 100lbs soaking wet. You can’t convince me that she was so much stronger than him that he couldn’t force her hands behind her back without having to use brute force. What, is she the incredible hulk or something? My mom could force her hands behind her back she is in her 60’s!!!! I think he pretended like restraining her was difficult so that he could abuse her. For shame!!! I think it’s perfectly believable that she was scared. Try to remember what it was like to be 15. I think i’d freak out too if a cop tried to arrest me at 15. Adults should know better when dealing with children…

    Let me tell all of you skinhead, KKK ‘jerkweeds’ something! First off, there is nothing in the curfew law that says a teenager will be arrested if caught violating the curfew. Second, it does say that on first offense, the teen WILL receive a “written warning” from the ‘pig’. Third, she was only yards away from her home. Fourth, the cop never tried to find out who she was or where she was going or even why she was out. Fifth, there IS a ordinance against teenage abuse that the pig violated. Sixth, the pig violated EVERY principle concerning the most basic thing that cops are taught… ‘use of force’ AND calling for back up. that fucking coward ass white man was clearly abusive and couldn’t even handle a 15 year old girl so you know he can’t handle ANY man!!! How fucking pathetic is he to be hitting a female… something cops arrest men for all the time in domestic situations if there is even a hint of abuse when they arrive?? People like this are the types who were either a) geeks who were picked on in school all their lives OR b) molested by their dad all their lives AND now he wants to take it out on the world.     They should also arrest the mother for not bringing up this kid to have enough sense! If the child was retarded I could understand the bitter feelings. Our Laws are no good unless we are able to enforce them. Color or race is incidental. If the police tell you to stop and you dont then you must be stupid or retarded. Even if I have not done anything wrong I would gladly hold my hands up and respect the police. They need to be able to protect the people and themselves.

  17. hi i just map quested where this young girl lives and where she was arrested for curfew and she was on the block down the street from her house this shows police brutality and the officer can not handle a 100 lb teen like this he probably searched her instead of a woman officer which also violates her rights looking forward to all evildoers getting their due as for this girl she now has a record and will be harrassed from the cops the rest of her life i am white and hate the police this is not a race issue the cops are being trained by blackwater as we speak so they can turn on us all in the us soon you’ll learn when it’s all too late

    I have been reaidng all the previous responses and I watched the video a couple times first off the girl was indeed in pain, she had a garbage bag in her hand forget curfew she wasn’t commiting crime I mean c’mon why did he have to arrest her? There are far worse things going on. She resisted assualt ok but she a girl my age I wouldn’t have probably bit him but out of frieght who know’s what I would have done. I think people are over looking this it’s WRONG up and down all the way… you don’t know all the hate I had mustered up in my mind and heart that a big ass man like him would do such a thing….

    This is sad. The police officer obviously lacks good judgment. This incident could have concluded with a 1 minute ride down the street and a knock on her parents door if the comments about the distance between the site where she was arrested and where she lived is correct. Whether its legal to do something and whether its right are two different issues. This child’s life will never be the same. We all make bad decisions at that age and regardless of the amount of media attention the incident gets this girls life will be negatively impacted by this incident for years to come. This is the true injustice, that one bad decision might possibly ruin this girls life.

    In regards to race, people respond to events based on their reality, if that reality includes a historically justifiable mistrust of the police, then that reality must be acknowledged and addressed appropriately.

    We imprison so many people in this country, a disproportionate number of them people of color. You would think police officers would be trained to resolve non-violent offenses that don’t threaten the immediate safety of the community without arrest.

    Eye contact, a deep breath, and a non arrest resolution like: “I’m not taking you to jail, but I do need you to put your hands behind your back for your safety and my own, before we go to your home” could have saved this girl, this officer, and the Fort Pierce police a lot of headache. Good judgment would say arresting this upset little girl is going to be more trouble than just talking to her about the importance of following curfew and delivering her directly to her parents.

    Her actions were ridiculous.
    The officer was NOT trying to abuse her or be violent, otherwise you’d see him visibly excited and aggressive. Conversely, he is cool, calm, and collected.

    Question.
    What was the girl doing only a short distance away from her house? Why would you find a girl alone, a short way away from her house?
    You wouldn’t. You would find her in a park with a group of people, or somewhere far from home.
    Perhaps then, she was standing on the corner of the block? Perhaps not, but we don’t know. Thereby this invalidates any argument related to distance from home. (from our points of view anyways)

    Sista – is it customary for someone of this age and size to bite a police officer? or comply politely and quietly, because an innocent person will always comply politely and quietly. They have nothing to be afraid of, because they are innocent. A guilty person will put up a fight, because they know they are in trouble.

    Good point about possible past experiences producing mistrust in police. Your idea is inplausible though. of non arrest solution. He had to arrest her, and then take her home. Suppose he hadn’t arrested her, and she had run away? She was openly resisting the arrest, so there was a high chance she’d have run. 1. he’d have to go chase her down, because he can’t let her just run away 2. it wouldn’t be safe for her to be running around in the middle of the night

    I think had she been compliant, he could have opted for a non-arrest method, but she was so defiant to his authority he knew he couldn’t.

This video is another example of cops using their authority unjustly. “Why do you call cops pigs, when they are there to enforce the laws”. This foolish comment was made by a commentator on this site. Since when have cops used their authority righetously against blacks? NEVER. But lets just dismiss the race issue for one second. LOOK AT THIS GIRL. She is 100 pounds and very fragile. Throughout the duration of this video, this girl spends most of the time with her head pressed against the hood of the cop’s car? How can she resist arrest with her head pressed against a car. This cop was twice her size and I believe he could have easily arrested her. Perhaps when he twisted her arm back or when her socker punched her, I’m sure he could have used that energy to arrest her. Instead he used his authority and size to do whatever he pleased, even if they meant brutalizing a 15 year old girl. And for the record, the emphasis should not have been placed on why this girl was missing curfew. Thats her buisness.     I say, if police can legally manhandle this person then the parents should by law be able to manhandle and slap around their children. Parents should be able to beat their children. If they were given back that right then maybe we would have fewer bad children. People in this country are spoiling their kids and they do not even know it.     She was resisting arrest by not cooperating and biting the cop. The cop was being very careful, if he wanted to fuck her up, he never would have videotaped it. Think about that. He deliberately puts her in view of the camera. Because his intuition tells him that she is trouble.

    As to claiming the emphasis not being about her breaking curfew and that being her business, the call to the cops was made by a neighbor being awoken by barking dogs and seeing people on the street with bags. It is the cop’s duty to investigate. If Shelwanda had only cooperated, she would not have been busted. If she had cooperated while being busted she never would have been pepper sprayed. Maybe not even handcuffed.

    Send this girl to diplomacy 101.

    And tell her to drop drama 101.

Officers can get a 200lbs man in handcuffs after about 30secs. But not a little 15year old girl. So I believe all this could of been prevented if he just would of done his job RIGHT and cuffed her then do what he need to do.

    The sad thing is, he probably spent way too long trying to reason with her- perhaps precisely because he knew that the situation could be delicate. I think he screwed up, but it’s obvious that he was trying to be a “good cop.”

    I don’t envy cops and the situations they find themselves in. Most people who do shit work for not much money don’t have to worry about becoming instant celebrities on top of everything else.

    Well i have to say that she was obviously resisting arrest. Whether she was 10 feet or 10 miles from home she was still being taken into custody and would not do what he said. If anyone else like say a 16 year old boy did that they would be maced and tasered. I think she got off easy with just the mace and he didnt break any rules.     And as for the punch, cops only wear thin leather gloves they are not some sort of “protection”. He would feel the bite right through and it could even still break the skin. And so if the “frightened” girl wasn’t in the right mind state then i would think he wouldnt be in the right mind state RIGHT AFTER being bitten. It was a shock and a reflexive action and it’s not like he continually punched her it was just once.
    He didnt break any rules stop being racist and stupid and get over it and no Qwick he didnt grab her boobs he was trying to restrain her…..
    She broke the law, He used force like any other person would receive, she went to jail end of story.

    Justin Forrall, you are wrong. You don’t have to do everything a cop tells you to do. They assume that the average citizen doesn’t know the law (and in most cases they don’t) which is why some people ::aheem:: feel they have to listen to everything the cops say. We don’t know what precipitated the whole altercation, but I still feel that the cop was wrong. Don’t get me wrong, I’m all for getting criminals off the street. And I’m sure this young lady was breaking the curfew law. BUT I’m also sure police guidelines don’t state “… and if still resist after the fourth warning, punch ’em, slam their head into the squad car, and then mace ’em.” The mace should have been done first if anything. Or call in for backup since that “She-Hulk” was obviously too much of a problem for him. Sure the pi-officer was doing his job, he just handled it unprofessionally. It’s just another sad situation between the cops and the public. It adds more animosity between the two, which is why so many people don’t respect the average policeman.

    The child was having an anxiety attack and was apparently very afraid of the police. I have a 14 year old and I know he would be terrified to even talk to a police officer so I cannot imagine what a little girl would feel.

    The officer should have recognised that the CHILD was having a nervous breakdown, was terribly terribly afraid, and acted with more compassion and explained that she was out beyond her curfew, that she is safe, but he will need to take her in.

  33. If you look at this over and over you will become so upset you will see that the racist cop pulls her over, out of the camera view to inflict pain on this child. Then watch what he does when he puts her back in front of the camera–He puts her arm behind her back and with brute, male force trys to break her wrist. That’s all you can say about that. He literally is trying to inflict pain and injury. Please, folks in Florida, don’t let him get away with this–your child could be next.

We are talking about breaking a CURFEW law–even if this was her 2nd or 3rd or 4th time, he was completely out of line period, but he figured “another darky–so what, no one will take her word over mine”. If you don’t believe that, then why did he pull that 80 pound girl out of camera sight? Do you hear her screaming?! What idiot said she should just do what the police say?! The police are not always a black persons ‘friend’ and any black man can tell you that. If you are an African American parent, please show this to your children and let them know that this is the way it is in 2010!
